Terms of Use (End User License Agreement)

Welcome to the mobile application and related services provided by Starly Live (the "Company", "we", "our", or "us"). These Terms of Use (this "Agreement" or "EULA") govern your access to and use of our mobile application and any related websites, content, products, and services (collectively, the "Service"). By downloading, installing, accessing, or using the Service, you agree to be bound by this Agreement.

Apple EULA Notice: If you downloaded the app via the Apple App Store, Apple's Standard End User License Agreement applies in addition to this Agreement. In the event of a conflict, this Agreement governs your relationship with us to the extent permitted by applicable law.

1. Eligibility & Use of the Service

  • You must be at least 13 years old (or the age of digital consent in your country) to use the Service. If you are under 18, you represent that you have your parent's or legal guardian's permission.
  • You agree to use the Service only for lawful purposes and in accordance with this Agreement and all applicable laws and regulations.

2. Limited License & Ownership

  • We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Service for your personal, non-commercial use on devices you own or control and as permitted by the App Store Terms and this Agreement.
  • All rights, title, and interest in and to the Service (including software, designs, text, graphics, images, and other content) are owned by us or our licensors and are protected by intellectual property laws.

3. Subscriptions & In-App Purchases

  • Some features may require an auto-renewable subscription or other in-app purchases available within the app ("IAPs"). Pricing and available durations (e.g., weekly, monthly, or yearly) are displayed in the app at the point of purchase.
  • Payments are processed by Apple via your Apple ID. We do not collect or store your full payment information.
  • Your subscription will automatically renew for the same period and price (or as otherwise shown in the app) unless you cancel as described below.

4. Virtual Items & Coins

  • The Service may offer virtual items or credits (e.g., "Coins"). Virtual items are licensed, not sold. They have no real-world monetary value, are non-transferable, and are non-refundable to the fullest extent permitted by law.
  • We may manage, regulate, modify, or eliminate virtual items at any time. We will have no liability to you or anyone for the exercise of these rights.

5. Billing, Free Trials, Renewal & Cancellation

  • Free Trials: If offered, free trials convert to a paid subscription at the end of the trial unless you cancel at least 24 hours before the trial ends.
  • Auto-Renewal: Subscription renews automatically and your Apple ID is charged within 24 hours prior to the end of the current period.
  • Cancel Anytime: You can cancel or manage your subscription in your Apple ID settings: open Settings > tap your name > Subscriptions > select the app > Cancel Subscription. Deleting the app does not cancel a subscription.
  • Refunds: App Store purchases and refunds are handled by Apple. To request a refund, visit Apple's "Report a Problem" page or your purchase history.
  • Price Changes: If prices change, Apple may notify you. Continued use or failure to cancel constitutes acceptance of the new price.

6. User Accounts, Security & Deletion

  • You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  • You must provide accurate information and keep it up-to-date.
  • Account Deletion: You may delete your account at any time from within the app (Settings → Account → Delete Account). If you prefer, you can also request deletion by contacting us at contact@starlylive.com. Deleting your account is permanent and will remove or anonymize personal data as required by law, subject to data we must retain to comply with legal obligations.

7. Acceptable Use & Prohibited Conduct

  • Do not use the Service to violate any law, infringe rights, or transmit harmful, fraudulent, or illegal content.
  • Do not attempt to reverse engineer, decompile, scrape, or otherwise interfere with the Service or its security features.
  • Do not upload or share content that is unlawful, defamatory, obscene, harassing, hateful, or infringes the intellectual property or privacy rights of others.

8. Privacy

Your use of the Service is also governed by our Privacy Policy. For details on how we collect, use, and share information, please review our Privacy Policy.

9. Third-Party Services & Network

  • Certain features may rely on third-party services (e.g., authentication, payments, analytics, or telecommunications/VoIP). Your use of those features may be subject to the third party's terms and policies.
  • Some features (e.g., CallKit) may be disabled or unavailable in specific regions where required by law or platform policy.

10. Disclaimers, Limitation of Liability & Indemnity

  • Disclaimer: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
  • Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
  • Indemnity: You agree to indemnify and hold us harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service or your violation of this Agreement.

11. Suspension & Termination

  • We may suspend or terminate your access to the Service at any time if we believe you have violated this Agreement or applicable law, or to protect the Service or other users.
  • Upon termination, the license granted to you will end, and you must cease all use of the Service. Sections intended to survive termination will continue in effect.

12. Changes to the Service or Terms

  • We may update the Service and these Terms from time to time. If we make material changes, we will provide notice (e.g., in-app notice or website update). Your continued use after changes take effect constitutes acceptance of the updated Terms.

Governing Law & Venue

This Agreement is governed by the laws of Pakistan, without regard to its conflict of laws principles. You agree to the exclusive jurisdiction of the courts located in Pakistan for the resolution of any dispute arising from or relating to this Agreement or the Service.

Severability & Entire Agreement

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. This Agreement, together with any policies referenced herein (including our Privacy Policy), constitutes the entire agreement between you and us regarding the Service.
